The purpose of these terms and conditions of sale is to define the contractual relationship between Did’s Design, 20 Chemin des Patinières, 74100 Vétraz-Monthoux, France Tel: +33 0800 910 358 72 (from France), contact@kitcini.fr

Siret 88838487200022 | Company Trade Register Number: 888 384 872 R.C.S. Thonon-les bains, and the individual purchaser on the other hand, and the conditions applicable to any purchase made via the KIT/CINI commercial site, www.kitcini.com. A private individual is a natural person who uses the Products for his personal needs and those of his family.

The acquisition of a good through this site implies unreserved acceptance by the purchaser of these conditions of sale.

These conditions of sale shall prevail over any other general or special conditions not expressly approved by Did’s Design. KITCINI’s commercial title (KIT/CINI) is as legally valid as the above-mentioned name.

2. Products offered

The products offered are those which appear in the catalogue published on the KIT/CINI site.
These products are offered within the limits of available stocks.

The photographs in the catalogue are as accurate as possible but cannot ensure perfect similarity with the product offered, particularly with regard to colours.

3. Sales

3.1 The Products are offered for sale while stocks last. Our product offers are valid as long as they are visible on the site, within the limits of available stocks.

In the event of an unavailability of product after placing your order (stock error or other case), we will inform you by email or phone. We will then offer you the choice of:

the refund of the missing product or products by Credit card or Paypal
OR the refund in a purchase voucher
OR replacement by products of your choice of a value equivalent to the missing products
The validation of your order will be suspended until your response.

3.2 The minimum quantity per order is one (1) product.

3.3 KIT/CINI retains ownership of the Products delivered until full payment of the invoices and reserves the right to suspend delivery in the event of late payment and until the debtor account has been settled in full.

3.4 KIT/CINI reserves the right to refuse an order or to demand advance payment in the event of overdue invoices or insolvency.

Confirmation of the order implies acceptance of these conditions of sale, acknowledgement of full knowledge thereof and waiver of the right to invoke its own conditions of purchase or other conditions.

All the data supplied and the recorded confirmation will be deemed proof of the transaction. Confirmation shall constitute signature and acceptance of the transactions carried out.

The seller will send confirmation of the recorded order by e-mail.

4. Product returns

4.1 Regardless of the distribution channel used, you have 14 days from receipt of the Product to notify us of your wish to return it if it does not suit you, and then 14 days from this notification to return it to us, without having to give any reason. To exercise this right of return, you may make an unambiguous statement indicating your intention to return the Product to us.

4.2 For health and safety reasons, only Products that are unused (unopened), correctly protected, in their original, undamaged packaging, in perfect condition, fit for resale, accompanied by any accessories, instructions for use and documentation, as well as the corresponding invoice, will be returned. These conditions are cumulative and apply to each product returned.

4.3 Subject to the foregoing, KIT/CINI will reimburse you by bank transfer the price of the Products returned and the shipping costs invoiced (on the basis of standard shipping costs), if they have already been paid, within 14 days of the date on which you exercised your right of return. You will be responsible for the cost of returning the goods.

5. Satisfaction or your money back - Right of withdrawal

5.1 Right of withdrawal
In accordance with articles L.221-18 et seq. of the French Consumer Code, the non-professional Customer (hereinafter the “Consumer”) has a right of withdrawal of 14 (fourteen) clear days from the date of delivery of the Product ordered on the Website, without having to justify reasons or bear penalties except for return costs. When this period expires on a Saturday, Sunday or public holiday or day off, it is extended to the following working day. To exercise this right, the Consumer must inform KIT/CINI of his decision to withdraw by calling 0800 910 358 72 (from France) or by e-mail to contact@kitcini.fr or using the withdrawal form.

The Consumer will have a period of 14 (fourteen) days following communication of his decision to withdraw to KIT/CINI to return the Products concerned unused in their original packaging and in perfect condition allowing them to be remarketed in new condition. If this time limit is not respected, the retraction will not be accepted.

5.2 Reimbursement will be made as follows : :
Returns should be made to KIT/CINI, 20 Chemin des Patinières, 74100 Vétraz-Monthoux FRANCE. The cost of returning the goods shall be borne by the Customer.

If the parcel is returned in its entirety, the amount of the order including delivery costs (standard postal rate) will be reimbursed;
If the parcel is not returned in its entirety (the Customer retains one or more of the Products ordered), the price of the returned Product(s) will not be refunded.

KIT/CINI will refund the price of the order using the same means of payment as that used by the Consumer for the initial transaction.

In accordance with article L.221-23 of the Consumer Code, the liability of the Consumer may be engaged in the event of depreciation of the Products “resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of these goods”.

5.3 Order cancellations
Order cancellations are not possible insofar as, barring exceptions, orders are sent for preparation as soon as payment has been validated.

6. Payments

6.1 For any information concerning the price of the Products, their characteristics and delivery charges, you may contact La Maison KIT/CINI, ask us by post, by telephone or via the KIT/CINI site at the numbers and addresses mentioned in article B.2 below.

6.2 The prices appearing in the catalogue are prices inclusive of tax in euros taking into account the VAT applicable on the day of the order ; any change in the rate may be passed on to the price of the products.

Maison KIT/CINI reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalogue on the day of the order will be the only price applicable to the purchaser.

6.3 In the event of non-payment of the sums due on their due date, a conventional late payment penalty of 10% of the amount of the sums due will be demanded with a minimum of €15 per debt. This penalty may not exceed €40 regardless of the total amount outstanding.payments will be made by credit card; they will be made via the secure system which uses SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software and no third party can gain knowledge of it during transport on the network.the buyer’s account will only be debited once the transaction has been accepted by the bank.

7. Delivery and delivery charges

Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area

Delivery charges in mainland France are those in force on the day the order is placed, as shown in the prices applicable on that date.

In the event of delivery outside mainland France, you are responsible, as the importer, for paying all customs duties, taxes or other charges imposed on arrival of the goods.

Transport and delivery costs depend on the following geographical zones and order amounts:

8. Shipping and delivery times

8.1 – What are the shipping times?

KIT/CINI will endeavour to ship your order within 48 working hours from Monday to Friday.

8.2 – What are the delivery times?

Deliveries are made by the So Colissimo service of La Poste and Chronoposte to the customer’s home address against signature.

To metropolitan France and Monaco : 48h be 2 working days.
To the international : 5 to 8 days.
For more information, please consult the international delay calculator. La Poste makes every effort to meet these delivery deadlines.

However, an incident beyond our control may cause a delay, for example in the event of exceptional weather or an incident related to the shipment (unreadable or incomplete address etc.)

Please note that the risks of loss and deterioration of the products are transferred to you on delivery.

9. Guarantees

All products supplied benefit from the legal guarantee provided by articles 1641 et seq. of the Civil Code.

In the event of non-conformity of a product sold, it may be returned to KIT/CINI who will take it back, exchange it or reimburse it.

10. Disputes

You are responsible for checking the number and condition of the Products upon receipt and, in case of damaged or missing Product, to make use reservations with the carrier and inform Maison KIT/CINI in the 7 days from receipt (keeping the invoice and signed delivery note). KIT/CINI will then provide you with identical replacement products or will refund you..

11. Consumer mediation

These GTC are subject to French law.

The Customer is informed that in case of a complaint with the customer service of La Maison KIT/CINI, and in the absence of a satisfactory reply or an amicable settlement within 60 days, he may refer the matter to the Ombudsman for Consumer Affairs, whose contact details are as follows:

The mediator’s task is to try, in an independent and impartial manner, to bring the parties together with a view to reaching an amicable solution. The Client is however free to accept or refuse the use of mediation and to bring the matter before the competent courts.
